The motorcycle death attorneys at Buckfire & Buckfire are reporting a tragic story in the news about a fatal Salem Township, Michigan car accident that killed motorcyclist, Williard Combs, on Pontiac Trail, just north of Five Mile Road, on Friday August 3rd.  According to police, Combs was hit by a car in the southbound lane of Pontiac Trail after his Harley Davidson had broken down. Combs, who was not wearing a helmet at the time of the accident, was thrown from his motorcycle and into the windshield of the car that struck him. He was pronounced dead at the scene of the accident.  Sarah Patton, the driver of the vehicle, suffered minor injuries due to the car-motorcycle accident. The Salem Township motorcycle accident is still under investigation.

I am deeply sorry to hear about this accident. My condolences go out to the family of the deceased victim.

According to the National Highway Traffic Safety Administration (NHTSA), 75% of all motorcycle accidents happen when a vehicle fails to see the motorcycle before the accident. Other common causes of motorcycle accidents include trucks or cars forcing motorcyclists into guard rails, speeding by the vehicle driver and/or motorcycle rider, and vehicle turning left before a motorcycle on the road.

Approximately 90 percent of all motorcycle crash fatalities include a motorcycle with another vehicle. In 2008 alone, about 5,290 people died in the United States from motorcycle accidents which is one of the highest mortality rates ever documented.

Our motorcycle accident Michigan attorneys advise victims of their legal rights. Bikers and motorcycle passengers injured in a motorcycle accident may be entitled to Michigan no-fault insurance benefits.  The eligibility for these benefits is based upon a number of factors, including whether the motorcycle was insured, the ownership of the motorcycle, and the facts of the accident itself.  The determination as to whether injury victims can receive these benefits involves a number of complex legal issues and it is therefore important that an experienced Michigan motorcycle accident lawyer be consulted as soon as possible so that important insurance filing deadlines are not missed.

For this motorcycle accident in Salem Township, the family of the deceased victim may be able to make a claim for Survivor Loss Benefits. This can include payment of funeral expenses and loss of other services.

In addition, the family members of the deceased victim may also have a claim for a Michigan wrongful death lawsuit against the driver of the vehicle if determined to be at fault. At the very least, an experienced Michigan motorcycle accident lawyer should be contacted to discuss legal rights.
