Bike Accident Lawyer in Michigan Wins Settlement For Canadian Motorcyclist

In addition to his injuries, the Canadian biker, who was a self-employed building contractor, was forced to miss approximately two months of work due to his injuries.

Michigan law provides a special rule for dealing with rear end accidents.  MCL 257.402 provides that drivers who hit the rear end of a car “shall be deemed prima facie guilty of negligence.”  This means that Michigan law creates a presumption that the person who hit the rear end of another motor vehicle is at fault for the crash and guilty of negligence.

In addition to that special ruling, there are also others laws that make it very difficult to rebut the presumption or prove the driver who rear ended the other vehicle was not negligent.

The motorcycle lawsuit was filed in the Muskegon County Court as the accident took place in Muskegon, Michigan on Shoreline Drive.  Our client was stopped at a red light on his bike when a driver failed to stop at the red light and rear-ended the car in front of her, which resulted in that vehicle hitting our client’s motorcycle.
